CMS Vaccine Mandate Stayed by Federal Courts
Preliminary injunctions issued by two federal district courts have temporarily stayed the enforcement of the vaccine mandate issued by the Centers of Medicare and Medicaid Services (CMS). In addition, CMS stated that it is suspending any actions related to the implementation of the vaccine mandate and its enforcement. One of the court orders, issued by the U.S. District Court for the Eastern District of Missouri, blocks the mandate from being implemented across 10 states listed in the lawsuit that was filed. The other court order, issued by the U.S. District Court for the Western District of Louisiana, would block the mandate nationwide. The Biden Administration sought to challenge the two court orders through the U.S. Court of Appeals. The 8th Circuit Court of Appeals ruled against the Biden Administration’s challenge of the Missouri court order. However, the 5th Circuit Court of Appeals is considering the Biden Administration’s challenge to the Louisiana court order, which has national implications.
